“The project will be implemented over a three year period. Site work, utility and asbestos abatement work will begin in the SUMMER OF 2009. Selective building demolition will begin in late summer 2009 when asbestos abatement work is completed. Building construction will begin in December 2009.”

The district filled for appeal of zoning ordinance items January 22 2009.

The board has not approved the plan yet the district has filled for special permits, changes in zoning, purchased property, plans earthwork within a floodplain and construction within 600′ of eagles nest.

Erosion and sedimentation Question: “Give the acreage to be graded or excavated and the cubic yards of soil to be moved. Answer: 12 acres – 115,000 cubic yards.”

That 115,000 cubic yards of soil is within the 300 ft. shoreline of the 40th Ave. E creek. The district is “in the process of amending the one hundred year flood plain map through the FEMA Letter of Map Amendment Process. However, no land-altering activities will occur in this area.” So a new Public School Stadium, new multi purpose field and retaining walls with 115,000 cubic yards removed will is apparently not “land-altering activities”.

AND MORE this excavation is within 300 ft. of the nesting site of a protected bald eagle pair yet the district says on page 5;

“A known/identified eagle’s nest is located in the southwesterly area of the expanded school property, but IT IS NOT RELATIVELY CLOSE TO ANY EXPECTED AREAS OF CONSTRUCTION.”

AND YET

“restricting construction and/or LANDSCAPE ALTERATION in the Secondary Zone (330-660 feet of the nest).”
