FedExing me to death

I just had my latest fedEx sent to me. Why me when it was for another plaintiff I have no idea. The letter that was sent to all the other plaintiffs but not to me made it clear they were all on their own until such time as they engaged one of their own.

This Fed ex was drafted on Thursday the 13th. Yesterday, Friday the 14th the School District’s defense counsel announced that they would challenge the jurisdiction of the Sixth District Court. Today, Saturday the 15th, the Trib reported today that this would have the effect of grinding all the legal actions to a standstill. Presumably this would include the depositions which the JCI defense attorneys are scheduling.

I only heard about the the School Board’s appeal of the jurisdictional questions from a reporter at about 3:30 yesterday afternoon. The District’s attorneys did not notify me although my mail has yet to be delivered today. Mary Schwind, the lead attorney for JCI, has begun sending me email. Presumably, the District’s attorneys could send me email as well. I’m not sure they’ll send me anything. Just as the District hates to share info so too do its lawyers. Birds of a feather.

I did manage to contact one of the attorneys I’ve been interviewing before business hours came to an end Friday. I was interested in knowing what the implications and consequences of this appeal would be. For instance, since JCI is a party but is not making the motion to challenge the jurisdiction are their plans to depose the plaintiffs put on hold? Without being able to get a gander at the actual motions the attorney really couldn’t offer any advice. I’ll have to wait till Monday or until the defense counsel lets me (the attorney pro se for myself but not for my fellow plaintiffs) in on the motions they are sending to the Appealate Courts.

I’m somewhat reluctant to ask the JCI attorneys what we should do. Its rather hard for me to believe they are not working hand in hand with the District lawyers. Maybe they were caught unprepared as well or maybe they are working in concert to double team us and simply operating under the legal fiction that they know nothing of what the other set of defense attorneys are doing.

I feel a little like Antonie van Leeuwenhoek the first fellow to grind small enough glass lenses to see microscopic animal life like the bugs in his saliva. He called them “animalcules.” (like molecules)They seemed to bump around randomly under his slides and were very mysterious. That’s kind of how the defense attorneys look to me.
